California enacts the country’s largest local-news employment credit

Gov. Gavin Newsom signed AB 2222 on Sept. 30. Beginning in 2027, qualifying California outlets can receive refundable credits of $20,000 for each of their first five full-time journalists, $15,000 for each additional full-time journalist, and another $15,000 for each newly created position. Part-time journalists can generate $7,500 credits. The program runs through 2031. ward.asmdc.org

Digital, print, and broadcast operations can qualify. The final law recognizes sole proprietors and includes photographers, videographers, reporters, editors, and digital producers. Full-time participants generally must work at least 30 hours weekly for more than 26 weeks and earn at least $35,000 annually. Qualifying outlets must publish a corrections policy, while political and social-welfare organizations are excluded. LegiScan

Why it matters: This is the most substantial enacted state subsidy for local journalism. Its employment-based structure avoids government selection of stories or grant projects, although implementation and eventual political pressure remain concerns.

Publishers lose an early antitrust challenge to Google’s AI summaries

U.S. District Judge Amit Mehta dismissed antitrust lawsuits brought by Penske Media and Chegg against Google on Sept. 30. The plaintiffs argued that Google required publishers to permit use of their material in AI Overviews to remain in ordinary search results, while the summaries reduced visits and revenue.

The judge ruled that the complaints did not establish an agreement requiring Google to send traffic to publishers, did not show AI Overviews and search to be separate products for tying purposes, and did not adequately establish several relevant markets. Why it matters: Publishers cannot assume that the long-standing exchange of crawl access for referral traffic creates an enforceable bargain. Search visibility remains commercially important, but this ruling offers little protection when Google changes how much traffic that visibility produces.

Publishers release a proposed accounting system for AI use

The SPUR Coalition published its Content Telemetry Standard version 1 on Oct. 2. The open-source framework defines five events that AI companies could report to publishers: when their work is retrieved, used as grounding, cited, presented to a user, and engaged with. Founding participants include the Associated Press, BBC, Financial Times, Guardian, Sky News and other publishers. The SPUR Coalition

No major AI provider has committed publicly to implementing the system. Google, OpenAI, Anthropic, Meta and Microsoft have been invited to participate, so the standard currently represents a publisher proposal rather than an operating measurement system. digiday.com

Why it matters: Search Console impressions do not show when an AI service retrieves journalism, relies on it without citation, or supplies an answer that eliminates a visit. Standardized records could eventually support usage reports and licensing payments.

OpenAI expands its investment in newsroom AI development

The Lenfest Institute announced Sept. 28 that OpenAI will provide another $5 million plus as much as $5 million in software credits and engineering assistance for its AI Collaborative and Fellowship Program. The program has placed technical fellows in 11 news organizations and now may expand to local television and statewide public-service outlets. The Lenfest Institute for Journalism

This is a funding announcement from the participating organizations. It does not establish that the resulting technology will improve revenue, reporting quality or newsroom efficiency.

Why it matters: The program gives larger newsrooms technical capacity that most independent publishers cannot afford. It also puts a major AI vendor in a central role in deciding which newsroom problems get engineering attention.

Appeals court protects publication of a government-released record

A California appellate court ruled Sept. 29 that journalist Jack Poulson, Tech Inquiry and Substack could not be held liable for publishing a truthful police incident report that had been released publicly without restriction, even though a court had ordered the record sealed. The journalist received it from a third party and did not know about the sealing order. The court also held that federal law protected Substack and Tech Inquiry from liability for Poulson’s independently produced material. law.justia.com

Why it matters: The ruling reinforces the principle that government should secure confidential information before release rather than punish a journalist who lawfully receives and accurately reports it. The decision directly governs California, though it relies heavily on U.S. Supreme Court press protections.

More About the Sun Than Of It

I wanted to be up early just for the chance to make this photograph. Haze from Canadian wildfires had transformed the morning and evening skies, offering better opportunities to photograph the sun well above the horizon, and I thought cornfields would make the perfect foreground.

Foreground is an important element in photographing the sun and moon, especially if a photographer wants a photograph that is more about the subject than about it.

The sun alone would have been little more than a bright disk in a colored sky. The corn gives it context. The stalks, leaves and tassels establish place, season and scale while remaining dark enough not to compete with the light above them.

The wildfire haze made the composition possible in another way. It reduced the sun’s intensity enough that the disk remained clearly defined while the sky held bands of red, magenta, and blue. The haze became part of the photograph’s visual structure, not merely an atmospheric condition.

The corn occupies nearly the entire lower half of the frame, yet it is rendered almost entirely as a silhouette. That reduction is useful. The field is immediately recognizable without much internal detail. The irregular heights of the tassels and leaves create a broken edge against the sky, keeping the foreground active without becoming distracting.

The sun sits above that edge, with enough separation to remain distinct. Its near-central placement works because the foreground is so irregular. The plants prevent the composition from becoming rigid, while the color shift in the sky adds another form of movement to the photograph.

The warmer tones high in the frame gradually give way to cooler blue tones near the corn. That contrast separates the sky from the dark foreground and gives the photograph depth, even though there is little conventional detail in the lower half.

The cornfield is therefore not merely something placed beneath the sun. It is what makes the photograph specific. Without it, the image could have been made almost anywhere.

With it, the photograph becomes about a particular morning, a particular season and a particular place.

That is the difference between making a photograph of the sun and making one about the sun.

Depth From Compression

This photograph depends on a long lens doing something that at first seems contradictory. Telephoto compression visually pulls the distant parts of the scene together, yet the repeated lines, changing light, and scale create a strong impression of three-dimensional depth.

The runners provide the immediate subject. They occupy almost entirely the bottom third of the frame, crossing a relatively bright section of roadway. Their bodies form a nearly continuous sequence from left to right. Luck helped considerably. At this instant they are unusually well spaced, with very little overlap. Each runner remains an individual figure while collectively becoming a single graphic element.

The light provides another separation. The foreground has a warmer quality, particularly in the pavement, skin, and clothing. Farther into the photograph, the scene becomes progressively cooler and more blue. Atmospheric distance reinforces that shift. The result is a foreground that feels physically distinct from the background even though the long lens has compressed the apparent distance between them.

Main Street supplies the depth.

The double yellow lines begin behind the runners and repeatedly disappear and reappear as the road rises and falls. Curbs, sidewalks, utility lines and rows of streetlights all recede toward the center. Each becomes progressively smaller. The rolling roadway is particularly important because we don’t simply see a road narrowing toward a vanishing point. We see successive sections, almost like overlapping planes.

The long lens compresses those planes enough to make the repetition obvious. Cars, traffic signals, streetlights, and utility poles appear stacked along the street. Instead of becoming clutter, much of that repetition describes distance.

Camera position is equally important. The photograph is made almost directly along the axis of the street. A position substantially to either side would weaken the convergence and change the relationship among the objects.

This photograph contains an interesting second photograph. A severe crop retaining principally the bottom third could still work. The runners themselves have enough spacing, color, and gesture to sustain a composition.

But something would be lost.

Without the deep background, they could be runners crossing almost any street. The full frame tells us that this particular street matters.

The background doesn’t compete with the runners. It explains where they are.

That is one useful characteristic of deep depth of field in documentary photography. Background detail need not merely be tolerated because everything happens to be sharp. Here, sharpness allows the distant information to participate in the storytelling.

The runners provide the moment. The street provides the place. The long lens pulls the two together.

What Remains

A photograph can describe a place without completely explaining it. Sometimes what is withheld is what gives the photograph its strength.

When I made this photograph, this small piece of farmland was already surrounded by apartments, businesses, and asphalt roads. Yet from this position, almost none of that intrudes. The house, tree and field occupy their own small world.

The composition establishes the location through three principal elements. The old house enters from the left but is deliberately incomplete. The enormous tree dominates the center. Beyond it, the field opens into sunlight and extends toward the distant tree line.

The house may be the most important element precisely because we see so little of it.

We see weathered siding, windows, and deep shadows beneath the tree. We don’t see the entire structure. No conventional view explains its architecture or condition. The frame cuts it off, leaving enough evidence to establish its presence but not enough to satisfy our curiosity.

That incompleteness creates questions. What does the rest of the house look like? How old is it? Who lived there? Why is this farm still here? What surrounds it? Why did the photographer consider this particular place worth remembering?

The tree works differently. Its massive trunk divides the enclosed darkness around the house from the open field beyond. Its branches spread across the top of the photograph, holding the house and field together beneath a common canopy. Visually, it feels permanent.

History proved otherwise. The house was left to deteriorate until it eventually had to be demolished. The tree remains. The farm remains. Memories of the people and life associated with the house remain.

And the photograph remains.

That changes what the composition means over time. What was once a partially concealed house is now something the viewer can no longer walk around the corner to see. The unanswered questions contained in the photograph have become permanent.

Other photographs can answer some of them. That may be one measure of the strength of this one. It doesn’t attempt to tell everything about the place. It establishes its character strongly enough that the viewer might want to see the next photograph, and then another, to discover why this house, this tree and this small surviving farm mattered.

A storytelling photograph doesn’t always have to provide the answers. Sometimes its strength is in making the viewer ask the questions.

Story Without Detail

Before sunrise at Hoover Reservoir, there isn’t enough light to describe the people in the conventional sense. That absence of detail becomes one of the photograph’s strengths. We don’t need to see anything about the specific subjects to understand what is happening.

The silhouettes provide nearly everything necessary. A person stands at the end of the dock on the right. A small fishing boat sits farther out, its occupants reduced to shapes. The landing net rising from the boat supplies an especially useful clue. Without revealing much, the photograph establishes fishing, water, people, and the beginning of a day.

The composition depends on balancing asymmetrical elements. The two docks enter from opposite sides and lead toward the open water, creating a broad visual structure across the bottom of the frame. The standing figure gives substantial weight to the right side. The smaller but more complex silhouette of the fishing boat and its occupants counters it on the left. A tighter crop that removes the subject on the right would flatten the photo and reduce its depth.

The empty water between them matters. Filling that space with another boat or person would weaken the separation of the two principal elements. Instead, each has room to exist independently while remaining part of the same scene.

There are also several strong verticals. The dock posts rise through the horizontal layers of water, distant shoreline, and sky. The figure on the right becomes another vertical, while the net provides a smaller one within the boat. Those shapes keep the photograph from becoming a succession of horizontal bands.

Before sunrise, the sky and its reflection provide most of the color. The dark shoreline divides them, while the silhouettes anchor the softer gradations of blue, gold and pink. Exposing for that light allows the foreground figures to fall naturally into darkness.

That darkness removes individual identity but preserves human activity. We know enough from posture, shape and context to construct the scene ourselves.

The photograph therefore depends on an apparent contradiction: by showing less about the people, the silhouettes make the activity easier to see.

One Scene, Two Ways of Seeing

The assignment was simple: make a single photograph that represented the garage sale at the senior center. The complication came when I produced two photographs that worked for entirely different reasons. Choosing between them meant deciding not which photograph was better, but which story I wanted the photograph to tell.

The wider photograph is about the garage sale itself. Two people emerge from the dark interior carrying floor lamps, an ordinary garage-sale transaction transformed into an unusual visual moment. The lamps immediately signal what is happening. The people are leaving with something they found and bought, while the activity visible inside provides enough context to place them within the larger event.

Its design depends heavily on repetition. Two people. Two lamps. Two tall vertical shapes moving forward together. The shades create large geometric forms above the figures, while the difference in their expressions keeps the symmetry from becoming too perfect. There is also an element of humor in seeing two people simply walking away carrying fully assembled floor lamps.

The second photograph moves away from describing the event and concentrates on one shopper. Now the lamps dominate. Their shades fill much of the upper frame and surround the woman’s face, turning merchandise into a compositional device. The “CASH ONLY” sign behind her adds a small but valuable piece of context. Even without seeing much of the sale, we understand that a transaction is occurring.

Distance changes the story. In the wider photograph, the moment organizes the frame. Both people are necessary to its balance and rhythm. In the closer photograph, proximity organizes it. One person disappears, the lamps become much larger graphic elements, and her expression becomes important.

If the assignment requires one photograph to represent the garage sale, the wider frame probably carries more descriptive information. But that doesn’t diminish the closer photograph. It simply has another purpose.

One says: This is what was happening at the garage sale.

The other says: This is what happened to one person at the garage sale.

The difficulty of choosing between them illustrates something useful about storytelling photography. Sometimes making the photograph that fulfills the assignment doesn’t end the possibilities. There may be another photograph, made seconds later and a few feet closer, that may tell a different story from the same event.

Wide angle: Building the frame, waiting for the moment

I had been photographing the operation for several days as lime was removed from the water plant’s holding ponds and delivered to nearby farm fields. By the time I made this photograph, I understood the process. What I didn’t yet have was this view.

The day before, I stopped at this location and took photographs with a normal lens. I also used my phone to test another possibility, shooting from beneath the tanker. The test almost worked. More importantly, it showed that the idea could work.

I returned the next day knowing where I wanted the camera.

The tanker would become the frame. Its dark underside across the top and portions of its structure along the sides would surround a considerably brighter scene. But the tanker wasn’t simply convenient framing. It was part of the story. The photograph would be made from beneath the vehicle delivering the material, looking toward the equipment transferring it for use in the field.

The roadway completes the bottom of that frame. Between those foreground elements is the working area, with the tractor and pumping equipment on the left, open sky across the background, and the operator moving between them.

Three tankers gave me three opportunities. The first was largely observation. Watching it unload revealed the pattern of the operator’s movements, where he went, how he handled the hose, and where those actions might place him within the composition I had already chosen.

The second tanker provided a first attempt based on those observations. It didn’t work as planned, as the tanker was too far back, changing the pattern.

The third worked.

At that moment, the hose creates the motion through the frame. It begins with the equipment on the left, runs across the ground, and then rises in a sweeping curve as the operator carries it. His stance and outstretched arms continue the sense of movement. The orange hose separates strongly from the grass and gives the eye a path through what otherwise could have been a complicated collection of machinery.

The wide-angle lens makes all of those relationships possible. The tanker is extremely close to the camera and therefore becomes visually imposing. Beyond it, the equipment shrinks progressively, while the sky provides an uncluttered background around the worker. Foreground and background establish both depth and purpose.

The photograph resulted from two different kinds of timing. One occurred over two days, recognizing a possible camera position, testing it, returning and studying the repeated operation. The other lasted only an instant, when the operator, hose and body position came together inside a composition that was already waiting for him.

The frame was planned. The moment wasn’t.

The photograph at the other end of the scale

My Fourth Friday photographs, including this one from 2023, usually sit at both ends of a large seesaw.

At one end is a deep stack containing most of the photographs I made. I've forgotten how many there are because the number doesn't matter other than weighing enough to balance the scale. At the other end sits a single photograph, one so striking that it seems the heavens intervened to hold the moment together just long enough for the shutter to release.

A photograph with enough density to balance all the failed others.

This is that photograph.

I made it without looking through the viewfinder. The camera was almost on the ground, where I used the dancers’ shadows to judge my position and the timing of the exposure. The wide-angle lens took in the full width of the performance, from the large foreground dancer to the main subjects, the surrounding dancers, the audience, and the buildings enclosing the street.

The aperture was set at f/22 to turn the sun into a star as it appeared between the central figures. The dancer in the air, the performer lifting her, the sun, the foreground figures, the long shadows and the converging lines of the stage all found their places within the same fraction of a second.

Some of that placement came from technique. Some came from anticipation. The rest feels divine.

Wide angle solves the photograph

I had photographed this farmer working this small field numerous times, but there was one photograph I had not been able to make. I wanted the American flag in the background to become part of the photograph rather than simply an object somewhere behind him.

I tried the seemingly obvious solution. A telephoto lens could compress the distance between the tractor and flag, visually stacking one against the other. I made numerous frames that way. None worked as well as this photograph.

The successful frame came with the 24–70mm zoom at the wider end of its range.

Instead of pulling the flag toward the tractor through telephoto compression, the wider view let both occupy their own space. The tractor and mower form a large foreground mass. The farmer remains clearly visible. The flag is much smaller, but its isolation against the dark trees and blue sky makes it immediately recognizable.

That difference in scale matters. The flag does not have to compete with the tractor for attention. It becomes part of the setting and, at the same time, a visual destination within the frame.

The composition also benefits from the distance that the wide lens preserves. There is foreground, middle ground and background. The mower stretches across the left side, the tractor occupies the right, and the flag rises above and behind them. The viewer can perceive the actual space separating all three.

There is an interesting contradiction here. The telephoto photographs were intended to make the relationship between tractor and flag stronger by bringing them visually closer together. The wide-angle photograph succeeds by doing almost the opposite. It allows the distance between them to remain visible.

After many photographs of the same farmer in the same field, the solution was not finding a new subject. It was finding a different spatial relationship among familiar elements.

Sometimes the photograph you have been trying to make reveals itself only when you stop trying to force the elements together.

This is an iPhone photo from a very brief series made about ten years ago called “Portrait in the Alley.” I stopped people late in the afternoon in this narrow space between two shops. The light was bright, somewhat directional, coming from behind the two- and three-story-tall buildings across the street. Soft and strong.

A portrait can communicate identity through restraint rather than action. Texture becomes central to the story, drawing attention to natural details often simplified or overlooked. The monochrome treatment removes the distraction of color, allowing shape, contrast, and expression to carry greater weight. A quiet profile and uncluttered setting create a sense of reflection and self-possession. The result is intimate without feeling intrusive, presenting individuality as something worthy of close observation rather than explanation.

Farmers’ markets offer easy color but difficult photographs. Produce may look appealing on its own, yet the strongest images also contain deliberate light, a clear subject, and a human gesture that turns a display into a scene.

In this photograph, the fruit is the obvious subject, but the hands create the moment. They suggest an exchange and bring the viewer closer to the action.

The lesson is simple: Look beyond the objects and wait for interaction. A basket of peaches can be beautiful. A basket being offered, carried or searched tells a story.

Move in close

Busy backgrounds are among the biggest challenges at outdoor markets. Signs, tents, tables, and passing shoppers can quickly clutter the frame. Moving closer simplifies the scene and gives the photograph more impact.

Here, the baskets nearly fill the frame. The tight composition removes most distractions and emphasizes the peach fuzz, the bloom on the blueberries and the rough wooden containers.

Before reaching for a longer lens, try changing your position. A few steps forward or to one side can improve the image more than a change in equipment.

Use color as structure

The warm reds and oranges of the peaches contrast with the cooler tones beside them. That contrast gives the photograph energy and helps separate the two sides of the frame.

At a market, look for color relationships. Contrasting colors often create stronger compositions than scenes dominated by similar tones. Red tomatoes against green baskets, yellow flowers beside a blue shirt, or purple onions against pale wood can provide natural visual structure.

Let the light reveal texture

Side light is especially useful for photographing food because it creates small highlights and shadows across the surface. In this image, the light catches the fuzz on the peaches and the dusty bloom on the blueberries. Those details make the fruit appear tactile and fresh.

The strongest work photographs do more than show a job being done; they let the viewer feel the effort.

What I like about this photo is how clearly it knows where the attention should go.

I keep coming back to that orange flower on the left. It is the one part of the frame that feels fully claimed, while everything else slips into color, light, and suggestion. When I made this photo, I focused less on detail and more on simplicity. Photographers often aim to show everything: the face, the clothing, the setting, and every texture. In this shot, I chose the opposite. I allowed the roofer to become a dark silhouette against the bright sun because I wanted shape, not detail, to tell the story.

What made the image effective for me was the worker’s outline. He’s standing on the roofline with one knee bent, leaning slightly forward, with a tool hanging at his side. I didn’t need facial features or extra background details to understand what was happening. His posture conveyed enough. It showed a person at work, elevated, exposed, and physically engaged. That’s something I try to remember when I shoot: gesture and contour can often say more, and say it faster, than detail ever could.

I wanted the composition to feel stripped down to its essentials. There are only three elements in the frame: the dark roofline, the silhouetted figure, and the bright sun set in a wide blue sky. I make a lot of photos at the Highlands wetlands. Frog Fridays, egrets, hawks, lilies, and sunsets all ask something different of me. They require patience and timing. They also demand attention and a real consciousness of craft. This image did too, even though it began as something simple. It started as an iPhone panorama, shot and fully edited on the phone.

What caught my attention here wasn’t just the color. Even so, it’s impossible to overlook. I know photographers are often cautioned about saturation, and that warning is justified. Too much can flatten a scene and make it seem fake. But I believe this photograph works because the structure was established first. The composition was already doing its job before the greens deepened or the sky turned rich with blues and purples.

When I built the frame, I was responding to how the wetland enclosed itself. Trees rose on both sides like pillars. Grasses clustered at the water’s edge.
